Acceptance and Enrolment Terms

  1. The programme fee includes: tuition, all course materials and Oxford EMI Training certificate.
  2. Airport transfers are not included. We will send travel directions to you on receipt of your payment.
  3. You will be formally enrolled on the programme and guaranteed a place once the signed Contract has been received. Please note that you are responsible for payment of any bank charges that may apply.
  4. A letter of acceptance will be sent to you once the signed Contract has been received.
  5. Oxford EMI Training reserves the right to cancel the programme in certain circumstances. In this case, your programme fee will be repaid to you.
  6. It is your responsibility to take out travel and medical insurance for your stay in Oxford.
  7. You are responsible for any damage you cause to University property during your stay.
  8. You are responsible for applying for a visa. Please apply for the necessary visa in good time, should you require one to travel to the UK. We will provide you with a letter of acceptance to include with your visa application.


Terms and conditions

  1. Formation of the Contract
    1. These terms and conditions and the Contract apply between Oxford EMI Training and the Participant.
    2. These terms and conditions shall apply to Oxford EMI Training’s provision of EMI programmes and any other services that Oxford EMI Training may supply to the participant enrolled on the programme.
    3. The Participant accepts that the Contract will govern relations between Oxford EMI Training and the Participant in respect of the services, to the exclusion of all other terms, conditions, warranties, guarantees, stipulations and representations, whether written or oral and express or implied (including any terms or conditions which the Participant purports to apply under any memorandum of understanding, booking form, purchase order, confirmation order or other document).
    4. No contract shall exist or be deemed to be formed between Oxford EMI Training and the Participant until the Contract has been duly signed by or on behalf of the Participant and received by Oxford EMI Training.
    5. Oxford EMI Training may from time to time change these terms and conditions without notice to the Participant.
    6. The headings in these terms and conditions are for ease of reference only and do not affect their interpretation or construction.
  2. Participant Information
    1. The Participant warrants and represents that all information submitted by the Participant to Oxford EMI Training in connection with or relating to the services (including, without limitation) is accurate and correct, and the Participant agrees to promptly provide Oxford EMI Training with any and all necessary information, co-operation and assistance (including, without limitation, any information, co-operation or assistance) as it may reasonably require in order to perform its obligations under the Contract.
  3. Programme Charges
    1. The Participant agrees to pay the total due on the invoice at the time of signing the Contract.
    2. The preferred payment method is through Bank Transfer and the bank details are provided on the invoice.
    3. Non-payment on or before the due date (time being of the essence) shall entitle Oxford EMI Training, without prejudice to any other rights that Oxford EMI Training may have, to suspend or cancel the provision of the services.
    4. The Participant shall make all payments due on the invoice without any deduction, whether by way of set-off, counterclaim, discount, abatement or otherwise.
    5. If any amount remains unpaid 30 days after the date of the final invoice the Participant will pay interest of 3% compound per calendar month from the due date until the date of payment.
  4. Programme Charge Refunds and Cancellation Policy
    1. The commencement of the Contract shall be the date on which the Administrator receives the copy of the Contract signed by the Participant. The Participant has the right to cancel the Contract at any time within 14 days of its commencement and receive a full refund of any payments made. To cancel please inform the Administrator in writing.
    2. Where a signed Contract has been received and the cooling-off period of 14 days has passed, if the booking is subsequently cancelled the Participant will be liable for the following charges. All cancellations must be received in writing.

    1. Where there are good reasons to do so Oxford EMI Training may cancel the course by giving notice in writing any time before the course is due to start. In this case, all monies will be refunded.
    2. Oxford EMI Training accepts no responsibility for any loss suffered by the Participant as a result of cancellation of the booking or termination of the contract by either party, and the Participant agrees to indemnify Oxford EMI Training against any claim made by any prospective Delegate against Oxford EMI Training attributable to such cancellation or termination.
  1. Insurance
    1. The Participant warrants and represents that he/she has used their best endeavours to ensure they have made all necessary insurance arrangements for their travel and stay throughout the duration of the course. Such insurance arrangements should include, but not be limited to, theft or damage to personal property, loss or theft of money, medical treatment cover, personal liability, personal injury, legal expenses and recovery of their respective fees for attending the course and/or associated travel costs as a result of their inability (for whatever reason) to attend the course (in whole or in part).
    2. For the avoidance of doubt, Oxford EMI Training accepts no liability for loss or damage to Participant property and shall not provide any insurance cover whatsoever to the Participant.
  2. Accommodation and Participant Status
    1. The Participant enrolled on the course, if they choose college accommodation, will be provided with accommodation equivalent to that enjoyed by college students for the duration of their attendance of the programme. For the avoidance of any doubt, the Participant shall not, by virtue of their attendance of the programme, the Contract or otherwise, acquire any right, title or interest in the student accommodation provided or any other premises or property.
  3. Limitations of liability
    1. Oxford EMI Training will use all reasonable endeavours to assist the Participant in resolving problems that they may encounter whilst in Oxford during their attendance of the course. This includes helping them to access private medical care where available. However, Oxford EMI Training excludes all and any liability in respect of any services or goods offered or provided by any third part(y)(ies) to the Participant.
    2. The Participant must have all necessary visas, permissions and consents required for their stay in the United Kingdom and attendance of the course.
    3. The warranties and undertakings given by Oxford EMI Training in these terms and conditions are given in lieu of all implied warranties, terms and conditions and, to the extent permitted by law, all conditions, warranties, representations or other terms, including any relating to satisfactory quality, fitness for a particular or any purpose, or the ability to achieve any particular result, are excluded.
    4. The following provisions set out the entire financial liability of Oxford EMI Training (including any liability for the acts or omissions of its employees, partners and sub-contractors) to the Participant:
      1. any breach of the Contract; and
      2. any representation, statement or tortious act or omission including negligence arising under or in connection with the Contract.
      1. Oxford EMI Training’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising under or in connection with the Contract shall be limited to the Programme Fees; and
      2. Oxford EMI Training shall not be liable to the Participant (and/or any delegate) for loss of profits; loss of business; loss of anticipated savings; loss of revenues; loss of opportunity; loss of goodwill, or loss of reputation whether, in each case, direct or indirect and whether or not the type of loss was foreseen or reasonably foreseeable. Moreover, Oxford EMI Training will not be liable for any indirect loss or damage suffered by the Participant.
    5. The Participant agrees to indemnify Oxford EMI Training and hold Oxford EMI Training harmless from and against all losses, liabilities, damages, costs and expenses (including legal fees and costs) suffered or incurred in connection with any claims, demands, actions or other proceedings made or brought by any third party arising from the acts or omissions of the Participant, the Participant’s negligence or the Participant’s breach of the Contract.
  4. Data Protection
    1. Oxford EMI Association shall take all reasonable care to ensure that Oxford EMI Training complies with its obligations under the current General Data Protection Regulations.
    2. Oxford EMI Training shall only use personal data provided by the Participant for the purpose of providing the Services.
  5. Force Majeure
    1. Oxford EMI Training reserves the right to defer the Start Date or to cancel the course if it is prevented from or delayed in providing the services and/or carrying on its business due to circumstances beyond the reasonable control of Oxford EMI Training including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable staff and/or materials.
  6. Severability
    1. If any provision of these terms and conditions (or part of any provision) is judged by any court or other body of competent jurisdiction to be illegal, invalid or unenforceable, the other provisions and the remainder of the illegal, invalid or unenforceable provision shall remain in full force and effect.
  7. Third Party Rights
    1. Nothing in these terms and conditions is intended to confer a benefit on, or to be enforceable by, any person who is not a party to them.
  8. Entire Agreement
    1. This Contract constitutes the entire agreement between Oxford EMI Training and the Participant in relation to the subject matter hereof and supersedes all prior agreements, arrangements and understandings between Oxford EMI Training and the Participant relating to that subject matter.
    2. Without prejudice to clause 1.5, no additional terms, amendments or variations to the Contract will be binding on Oxford EMI Training unless agreed in writing by Oxford EMI Training. The Participant warrants that he/she has not relied on or been induced to enter the Contract by any statement, warranty or representation (whether oral or in writing) made or given by or on behalf of Oxford EMI Training which is not set out in these terms and conditions.
  9. Anti radicalisation policy
    1. Oxford EMI Ltd supports the rule of law, individual liberty, democracy and respectful tolerance of different faiths or beliefs. We do not tolerate any views which encourage radicalisation or extremism. Radicalisation is the act or process of making a person more radical or favouring of extreme or fundamental changes in political, economic or social conditions, institutions or habits of the mind. Extremism means holding extreme political or religious views which may deny rights to any group or individual such as racism, homophobia, right-wing ideology, any religious extremism.
  10. Governing law and jurisdiction
    1. The formation, existence, construction, performance, validity and all aspects of these terms and conditions and the purchase agreement shall be governed by and construed in accordance with English law and each party hereby submits to the exclusive jurisdiction of the English courts.
